Consequences for legal compliance breaches vary depending on the type and severity. As a few examples:

 
 
  • A bribery offence committed by an individual is a criminal offence and punishable on conviction by imprisonment for up to 10 years and/or a fine up to $2.1 million, while a bribery offence committed by a company is a criminal offence punishable on conviction by a fine which can be up to the greater of (a) $21 million; (b) 3 times the value of the benefit; and (c) 10% of the annual turnover of the company during the previous 12 months.
  • Serious or repeated non-compliance of the Privacy Act could result in a penalty being imposed of up to $2.1 million for companies. However, reforms are being proposed which would increase this amount to the higher of: (a) $10 million; (b) 3 times the value of the benefit gained from the breach; and (c) 10% of annual turnover.
  • In August 2017, AUSTRAC (the “Australian Transaction Reports and Analysis Centre” which is responsible for regulating anti-money laundering and counter-terrorism financing) commenced court action against the Commonwealth Bank for numerous alleged breaches the Anti-Money Laundering and Counter-Terrorism Financing Act 2006. The alleged breaches included failure by the bank to submit threshold transaction reports on time on thousands of occasions. Other allegations against the bank included failures to report suspicious matters within the required time frame. In 2018, AUSTRAC and the bank agreed to a penalty of $700 million to settle the court proceedings. In November 2019, AUSTRAC commenced legal proceedings against Westpac alleging “systemic non-compliance” with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006, involving alleged breaches of the Act on more than 23 million occasions.
